EMIGRATION TO AUSTRALIA.
THE fine first-class Ship, CITY OF EDINBURGH, of 500 tons, VALENTINE RYAN, Commander, will sail from Gravesend on the 2d, and from Plymouth on the 15th May, direct for SYDNEY. This ship’s poop and other accommodations are equal to those of a regular Indiaman; her ‘tween decks unusually lofty and well ventilated; and the entire arrangements for the comfort of cabin, intermediate, and steerage passengers cannot fail, on inspection, to give satisfaction. An experienced Surgeon will proceed in her, and the day appointed for sailing will be punctually adhered to. Married Mechanics and Agriculturalists are greatly wanted in this colony; such persons, of good character and not exceeding 30 years of age, may obtain a passage by this ship, at a very small cost to themselves.

N.B.Capt. Ryan made his passage last year from Portsmouth to Sydney, in 100 days.

STOLEN or Strayed, from Clear Creek, and supposed to have gone back to his run Summerhill, a HORSE betwixt a black and a brown, with short switch tail, with white face, and branded AC on the off shoulder and under the saddle. This is the last Will and Testament of me Isaac Whiley of Fernleigh House regent street Redfern near Sydney in the Colony New South Wales gentleman hereby revoking all former and other wills codicils and testamentary dispositions by me at any time heretofore made and declaring this only to be and contain my true last will and Testament I do hereby give and bequeath my dear wife Mary all my household furniture and effects consumable stores pictures apparel ornaments and all paraphernalia usually called hers for her own absolute use and benefit I give devise and bequeath all the residue and remainder of my estate and effects real and personal whatsoever and wheresoever to my son James Whiley of Condobolin in the said Colony Grazier and Thomas Walker of Redfern in the said Colony Van Proprietor who are hereinafter styled my Trustees to hold the same according to the nature thereof respectively unto and to the use of my said Trustees their heirs executors and administrators but upon the trusts nevertheless and with ***** and subject to the ****** provisoses and declarations hereinafter contained (that is to say) Upon trust to permit and suffer my wife to occupy and reside in the house in which I now reside or to receive the rents and profits thereof at her option and to permit and suffer her to receive the rents issues and profits of all other my real estate and of all my other person who may become his widow for and during the term of her natural life with the like obligations to repair and insure in his case and in her case as hereinbefore imposed or made in the case of my wife And from and after the decease of my said son James and of his widow then upon trust to make such sale and absolutely dispose of the parcels of land hereinbefore limited in favour of my said son James and his widow and to divide the net proceeds thereof between all the children of my said son James then living and the issue of such of them as shall have departed this life leaving lawful issue then living in equal shares and proportions according to the rools And as to the parcels of land situate at Redfern aforesaid coloured red on the said plan upon trust for my son Charles Whiley for and during the term of his natural life and from and after the decease of my last mentioned son then upon trust for his wife Zebora or any other person who may become his widow for and my said son Charles and of his widow then upon trust to make sale and absolutely dispose of the parcels of land hereinbefore limited in favour of my said son Charles and his widow and to divide the net proceeds thereof between all the children of said son Charles then living and the issue of such of them as shall have departed this life leaving lawful issue then living in equal shares and proportions according to the rools And as to the parcel of land situate at Redfern aforesaid coloured yellow on the said plan upon trust to permit and suffer my daughter Betsy the wife of George Napoleon Landers of Sydney in the said Colony Railway Clerk to receive the rents and profits thereof for and during the term of her natural life and from and after the decease of my said daughter Betsy upon trust for her said husband during the term of his natural life with the like obligations to repair and insure in her case and in his case as hereinbefore imposed or made in the case of my wife And from and after the decease of my said daughter Betsy and her said husband upon trust to make sale and absolutely dispose of the parcel of land hereinbefore limited in favour of my said daughter Betsy and her husband and to divide the net proceeds thereof between all the children of my said daughter Betsy then living and the issue of such of them as shall have departed this life leaving lawful issue then living in equal shares and proportions according to the rools And as to the parcel of land situate at Redfern aforesaid coloured blue on the said plan upon trust to permit and suffer my daughter Susannah the wife of Theodore Scott of Sydney in the said Colony Agent to receive the rents and profits thereof for and during the term of her natural life and from and after the decease of my said daughter Susannah upon trust for her said husband for the term of his natural life with the like obligation to repair and insure in her case and in his case as hereinbefore imposed or made in the case of my wife And from and after the decease of my said daughter Susannah and her said husband then upon trust to make sale and absolutely dispose of the parcel of land hereinbefore limited in favour of my said daughter and her said husband and to divide the net proceeds thereof between all the children of my said daughter Susannah then living and the issue of such of them as shall have departed this life leaving lawful issue then living in equal shares and proportions according to the rools And the parcel of land situate at Redfern aforesaid coloured brown on the said plan shall be held as a way or ways in common between all the holders for the time being of the several parcels of land respectively coloured green red yellow and blue And as to the parcel of land situate at the corner of George Street and Howick Street in the City of Bathurst with the buildings thereon erected called The Black Horse Hotel with the outbuildings upon trust to permit and suffer my daughters Maria Robinson and Eliza Frailey to receive the rents and profits thereof for and during the term of their joint natural lives subject to the like obligations as to repairs and insurance as hereinbefore imposed upon other life tenants and upon the decease of either of them then upon trust to receive the said rents and profits and after observing the said requirements of repairs and insurance to divide the clear residue between the survivor of my said daughters and the children of the deceased daughter lately entitle thereto in equal shares and proportions And upon the decease of the other of such daughters upon trust to make sale and absolutely dispose of the said parcel of land and to divide the net proceeds between all the children of my said daughters Maria Robinson and Eliza Frailey then living and the issue of such of them as have departed this life leaving lawful issue then living in equal shares and proportions according to the rools And as to the parcel of land situate in Durham Street Bathurst on which is erected the Wyagdon Hotel with the outbuildings thereon and the parcel of land in Black’s Lane Bathurst on which are erected three cottages and the vacant allotment in Black’s Lane Bathurst upon trust during the infancy if the youngest of my Grandchildren Joseph Creasey Elizabeth Doughty Creasey Edward Creasey Ida Fanny Creasey Albert Marfleet Creasey Blanche Lucy Creasey Mary Holland Creasey and Kirkby Seymour Creasey to collect the rents and profits of the said parcels of land and to apply the same or a competent part thereof in or towards the maintenance and education of my said grandchildren or such of them as my Trustees shall deem to need such provision and upon attaining twenty one years of the youngest of such grandchildren living to make sale and absolutely dispose of the said parcels of land nad to divide the net proceeds between all my said grandchildren then living and the issue of such of them as shall have departed this life leaving lawful issue then living in equal shares and proportions according to the rools I direct my Trustees to **** out and invest the sum of Six hundred pounds in the erection of a house on the parcel of land hereinbefore devised in favour of my daughter Susannah Scott her husband and children I direct the payment of my debts and the said sum of Six hundred pounds primarily out of my personal estate but if that shall not suffice then I charge the deficiency upon my whole real estate I declare that every estate and interest hereby limited to or in favour of a female shall be held for her separate use free from the debts control or engagements of any husband and shall be inalienate during coverture I declare that the trusts hereinbefore contained for realization of the freehold estates the subjects of my will shall not necessarily be exercised by my trustees immediately upon the happening of the event or events hereinbefore contemplated as the occasion or occasions of such sale or sales in case my Trustees shall deem it advisable for the interests of the persons interested in the property or properties then under consideration that such sale or sales should be postponed but that they shall be at liberty in each case to exercise such a discretionary power as may avail to prevent sacrifice I do declare that it shall be to all intents and purposes whatsoever as if he or they had been originally nominated a Trustee or Trustees by this my will And I do declare that every receipt in writing which shall be given by the Trustees or trustee acting for the time being in the execution of the trusts of this my will shall effectually discharge the person or persons taking the same from all moneys therein acknowledged to be received and shall exonerate such person or persons from all liability in respect of the application thereof And I do declare the Trustees or trustee hereby appointed or to be appointed as hereinbefore mentioned shall not be answerable or accountable the one for the other or others of them or for the signing of receipts for the sake of conformity or for any involuntary loss and that it shall be lawful for them to reimburse themselves respectively and to allow to their co-trustees respectively their costs and expenses incurred in discharging the trusts hereby in them reposed I appoint my said son James Whiley and the said Thomas Walker Executors of this my Will
