News-Arct* | 8 January 1886 | "The Burrowa News", Boorowa, NSW, Australia; SMALL DEBTS COURT. Mary McEncroe was summoned by Valentine O'Hehir for crossing his leased land with a horse and cart without permission. Damages were laid down at £5. Mr. F. P. Brennan appeared for the defence. Valentine O'Hehir deposed: On the 13th December last I met Mrs. McEncroe, and asked her if she was going through her purchase land; she asked what land; and I said the land you are on now; she then told me to summons her, and what ever she would be fined she would pay; I spoke to her often about it, but she made no reply, the land is not fenced; it is leased land; I claim £5, damages. To. Mr. Brennan; The Conroys come through where the defendant was; I have been threatening to sne defendant and the Conroys for trespass; I sue Mrs. McEncroe because she was the first and the last I saw going through; I have the land leased this eight years; she did not bring two funerals through on the same track; it is about five years since she commenced going through the land at first; there was no one with me when I cautioned her. Mary McEncroe deposed: O'Hehir is my son-in-law; I go through the land he has summoned me for trespasing on occasionally; I have taken two funerals through the same place; he has allowed me to go through this place for five years; I have several times seen teams going across the land; I used to go on the main road until he blocked it up; it is the only track I have to go on cmoing to Burrowa.
